These general terms and conditions govern the use of the website, bookings, ticket purchases, boat rentals, panoramic cruises, panoramic cruises with lunch, and other legal relationships between the provider and the user or the subscriber of the services.

These general terms apply to all website users and all bookings and purchases of the provider's services, unless otherwise agreed in writing in an individual case.

The provider reserves the right to change these general terms. For an individual reservation, the general terms that were in force at the time of the reservation or purchase apply.

The description of each service, price, duration, place of departure, included services, and any peculiarities are stated on the website, in the offer, or by agreement with the provider.

Reservations and online purchases

A reservation can be made via the website, email, telephone, or other agreed channel.

The contractual relationship between the provider and the subscriber is concluded when the provider confirms the reservation and when the payment conditions determined for the specific service are met.

For natural persons, the reservation is generally valid upon successful online or physical payment of the ticket, unless otherwise agreed.For companies and groups, the reservation is generally confirmed upon confirmation of the date and payment of the agreed advance payment, unless otherwise agreed.

If the website enables direct online ordering and payment, the user must be clearly informed before submitting the order about the essential characteristics of the service, price, payment conditions, cancellation conditions, and other information required by the applicable legislation of the Republic of Slovenia.

It is also possible to purchase tickets for individual cruises via the provider's website.

It is possible to buy tickets for the following services via the website:

- panoramic cruise by boat,
- sunset trip with sparkling wine,
- other services if expressly stated on the provider's website.

Online purchase is possible in the following languages:

- Slovenian,
- English,
- German,
- Italian.

Before submitting the order, the buyer is informed of the essential characteristics of the service, price, included services, payment conditions, cancellation conditions, place of departure, time of departure, and other information required by the applicable legislation of the Republic of Slovenia.

Before submitting the order, the buyer can review the selected services, check the entered data, and also correct any errors in the purchase process. The contract between the provider and the buyer is concluded when the buyer successfully submits the order and receives a confirmation of the order at the email address provided during the purchase.

After a successful online purchase, the buyer receives:

- order confirmation,
- invoice,
- reservation certificate or ticket with a QR code, at the email address provided during the purchase.

Upon boarding, the buyer presents the confirmation from the email or the QR code. Order data are stored, and the buyer has access to them via the electronic confirmation received after the purchase.

By submitting an online order, the buyer confirms that the order is linked to a payment obligation.

For tickets for services on a specific date and time, the 14-day right of withdrawal from the contract does not apply. For such cases, the cancellation policy specified in these general terms and conditions applies.

For online ticket purchases, payment is possible by card.

Cash is not possible for online purchases. Payment in cash is only possible in person on the day of the trip, when expressly enabled by the provider.

The place of departure for online purchased tickets is Portorož, unless stated otherwise for a specific service.

Buyers are recommended to arrive at least 20 minutes before departure.

The buyer receives more detailed instructions regarding the time and place of departure in the order confirmation or ticket.

For online purchased tickets, a change of date is possible upon prior agreement with the provider and depending on availability.

The provider reserves the right to cancel the trip or cruise also in the case of an insufficient number of registered passengers.

Due to the nature of the work, the buyer is generally informed of a possible cancellation due to an insufficient number of registrations on the day of the event.

In such a case, the provider enables the buyer:

- transfer of the reservation to another date, or
- a full refund of the amount paid.

When purchasing tickets for cruises or leisure services performed on a specific date and time, the consumer does not have the right to withdraw from the contract without stating a reason within 14 days of concluding the contract.

For cancellations of online purchased tickets in such cases, the cancellation policy specified in these general terms and conditions applies.

All prices are stated in EUR and include VAT.

Payment is possible by cash on the day of the trip, bank transfer, or card.

Unless explicitly stated otherwise, only those services and products that are explicitly stated in the description of the individual offer are included in the price.

For certain cruises, drinks are also included in the price, namely juice, water, and white wine, for the duration of the cruise, when this is explicitly stated in the offer or description of the individual service.

For a panoramic cruise with lunch on the boat, food is also included in the price when explicitly stated in the offer. Catering is carried out in cooperation with a local restaurant.

The provider reserves the right to make reasonable changes to the food or drink offer due to availability, seasonality, logistical reasons, or other justified circumstances, whereby the subscriber will be informed of significant changes whenever possible.

Reservation, cancellation and change policy

For companies and groups, upon confirmed reservation, an advance payment of 10% of the total value is paid to the provider's transaction account (TRR).

The total purchase price must be settled no later than 2 days before the event, unless otherwise agreed.

For natural persons, the reservation is valid upon online or physical payment of the ticket, unless otherwise agreed.

The subscriber can cancel the reservation free of charge up to 72 hours (3 days) before the trip. In this case, the total paid amount is returned.

In case of cancellation less than 3 days before the event or in case of a no-show, a refund is not possible, unless otherwise agreed.

The cancellation must be submitted in writing to the provider's email address: [email protected].

The moment of cancellation is considered the time when the provider receives the cancellation.

A change of date is possible upon prior written agreement and depending on availability.

Changes to menus, additional services, or the number of passengers must be communicated no later than 3 days before the event.

If the service includes catering, special dietary requirements, allergies, intolerances, and other adjustments are possible only if they are communicated to the provider in a timely manner and can be provided in cooperation with an external catering provider.

Deadline for communicating allergies and special dietary requirements: no later than 3 days before the event.

If the trip cannot be safely performed due to weather, dangerous conditions, sea conditions, technical reasons, force majeure, or other circumstances that may affect the safe performance of the cruise, the provider enables the subscriber:

- a new date, or
- a full refund of the amount paid.

The provider reserves the right, due to weather, sea conditions, or operational circumstances, to change the cruise route, departure time, or other reasonable program adjustments if these are necessary for the safe and appropriate performance of the service.

Such changes in themselves do not imply an automatic right to a refund of the purchase price if the service is performed in its essential part or in a comparable and safe way.

The provider does not assume responsibility for additional costs, such as transport costs, accommodation, or other related costs, unless the obligation to refund arises from applicable legislation.

Passengers must arrive at the departure point on time.

Recommended arrival before departure: 15 minutes before departure.

If a passenger or group misses the departure, the provider is not obliged to wait if this would affect safety, the cruise schedule, or other guests.In case of delay or no-show, the passenger is generally not entitled to a refund of payment, unless otherwise agreed or if so determined by applicable legislation.

For private rentals, a delay may affect the duration of the event, whereby the agreed completion time is generally not extended, unless the parties agree otherwise.

Rules during the voyage and obligations of passengers

Passengers must follow the instructions of the crew and all safety rules on the vessel.

The provider reserves the right not to accept a person on the cruise who:

- is under the obvious influence of alcohol or other psychoactive substances,
- endangers safety with their actions,
- behaves violently, offensively, or inappropriately,
- does not follow the instructions of the crew,
- causes danger to other persons or property.

In such a case, the passenger is not entitled to a refund of the purchase price.

For certain cruises, drinks are included in the price, namely water, juice, and white wine, if explicitly stated in the offer or description of the service.

Alcoholic beverages are served only in accordance with the applicable legislation of the Republic of Slovenia. The provider reserves the right, for safety reasons, to limit or refuse the service of alcoholic beverages to an individual guest.

Alcoholic beverages are not intended for minors. Minors must be under the supervision of parents, guardians, or other responsible adults during the cruise.

Pets:

Dogs are allowed on the boat. Throughout the cruise, they must be under the supervision of the owner and must not endanger safety, disturb other guests, or cause damage to the boat. The owner of the dog is fully responsible for its behavior, safety, hygiene, and for any damage the dog causes to the provider, other guests, or equipment on the boat

For a panoramic cruise with lunch on the boat, food is included in the price when explicitly stated in the offer.

Catering is carried out in cooperation with a local restaurant.

The provider will strive to ensure the accuracy of the menu description, but reserves the right to make reasonable changes to the menu due to seasonality, availability of ingredients, logistical, or other justified reasons.

The subscriber is obliged to inform the provider in a timely manner of any allergies, intolerances, or other special dietary needs of the guests.Upon prior agreement, it is also possible to provide a vegan or vegetarian menu.

As a rule, guests are not allowed to bring their own food or drink on the boat, except by prior agreement with the provider. On daily panoramic cruises, small snacks and refreshing drinks for personal use are exceptionally allowed.

Passengers are obliged to:

- provide accurate and complete data for the reservation,
- settle their obligations on time,
- act carefully towards the vessel, equipment, and other persons,
- respect the instructions of the crew,
- ensure that their actions do not endanger safety or the execution of the event.

The passenger is liable for damage caused intentionally or through gross negligence to the provider, vessel, equipment, or third parties.

The provider is liable for the performance of services with the diligence of a good professional and in accordance with the applicable legislation of the Republic of Slovenia.

The provider is not liable for delays, changes, or non-performance of services if these are a result of force majeure, actions of competent authorities, extreme weather conditions, technical emergencies, or the behavior of the subscriber or third parties over whom the provider has no influence.

The provider is not liable for the loss, theft, or damage of personal items of passengers, except when liability cannot be limited or excluded by applicable legislation.

If the subscriber does not communicate allergies, intolerances, or other special dietary requirements in a timely manner, the provider cannot guarantee menu adjustments.

Complaints and personal data protection

The user can submit a complaint or appeal in writing to the e-mail address: [email protected].

In the complaint, the user should state:

- their name and surname or title,
- contact information,
- date of service or reservation,
- description of the problem,
- claim.

The provider will process the complaint within a reasonable timeframe and in accordance with the applicable legislation of the Republic of Slovenia.

The provider processes personal data in accordance with the applicable legislation of the Republic of Slovenia, the General Data Protection Regulation (GDPR), and ZVOP-2. More detailed information on the processing of personal data is published in a separate Privacy Policy on the provider's website.

The website may use cookies and similar technologies. Non-essential cookies can be used only after appropriate consent from the user, while essential cookies are permissible even without it if they are necessary for the operation of the service or the transmission of a message. Details are regulated in a separate Cookie Policy.

All content on the website, including texts, photographs, logos, videos, and other materials, is protected in accordance with intellectual property regulations.

Without prior written consent from the provider, reproduction, distribution, or other use of the content is not permitted, except to the extent permitted by law.

In accordance with applicable legislation, the provider does not recognize any out-of-court settlement of consumer disputes provider as competent for settling a consumer dispute.

The provider publishes this information on its website and in these general terms and conditions.

If a consumer is not successful with a submitted complaint within the provider's internal appeal procedure, the provider will also provide information on the out-of-court settlement of consumer disputes provider where the consumer can continue resolving the dispute, in accordance with applicable legislation, in the response to the complaint.

The law of the Republic of Slovenia applies to these general terms and all relationships between the provider and the user.

The court with subject-matter jurisdiction in the Republic of Slovenia is competent for disputes, whereby mandatory rules of the applicable legislation of the Republic of Slovenia are taken into account in consumer disputes.

If any of the provisions of these general terms were invalid or unenforceable, this does not affect the validity of the remaining provisions.

These general terms are published on the provider's website and are valid from the day stated in these general terms.
